BOY CHARGED IN KILLING TO BE TRIED AS JUVENILE

A 15-year-old boy charged with murder in the stabbing death of his stepfather will be tried as a juvenile, a judge has decided.

The Wise County commonwealth attorney's office had sought to try the youth as an adult. At a hearing Friday, Juvenile and Domestic Relations Court Judge Elizabeth Sturgill denied the motion.

Jackie Rufus Bolling of Wise was fatally stabbed in the chest with a wood chisel Jan. 27. Bolling was arguing with his wife when the stepson intervened and stabbed the man, authorities said.

Assistant Commonwealth's Attorney J. Martelino Jr. said the judge's main reasons for the decision "were that the defendant had never been through the juvenile system before, he'd never been through counseling and a court service unit report recommended against the transfer."

Martelino said he would appeal the decision.
