$1.8 MILLION SUIT AGAINST DRIVER'S ESTATEI

The only survivor of a two-car crash that killed three people has sued the estate of the driver who collided with her truck, killing her husband and daughter.

Deborah S. Tuck, acting on her own behalf and as administrator of the estates of William W. and Stephanie R. Tuck, is asking for $1.8 million in damages from the estate of James Davis Reed, 47, a Blacksburg man who crashed into the Tuck's truck Feb. 19 on McCoy Road in Montgomery County.

Reed also was killed in the crash.

The accident happened after Reed's four-wheel-drive vehicle crossed the center line.

The medical examiner's office said in May that toxicology reports showed that there was alcohol in Reed's blood, but did not release the percentage.

Deborah Tuck suffered multiple bruises.

In the lawsuit filed Friday in Montgomery County Circuit Court, Tuck's attorney Kendall Clay said that Reed's negligence - exceeding the speed limit, failing to keep a proper lookout and driving after drinking alcohol - caused the deaths of Tuck's husband, 35, and daughter, 10.

Deborah Tuck has sustained financial losses and expenses, emotional losses and mental anguish because of her husband's death, Clay states in asking for $964,625 in damages.

Tuck also should receive $510,517 for financial loss, mental anquish and expenses in the death of her daughter, the lawsuit states.

Clay also is asking for $350,000 in damages to compensate Tuck for her personal injuries, emotional distress, and present and future medical bills.

The lawsuit was served on Robbie Jenkins, a Radford lawyer named as administrator of Reed's estate.
