DAMAGES AND JUSTICE

The concept of punitive damages plays an important role in our legal system; namely, punishing a defendant guilty of despicable conduct. Yet in recent years we've seen more and more lawsuits resulting in ``big money'' payouts even when the conduct was neither outrageous nor intentional. Unfortunately, when these payouts are too high, we all suffer the consequences, from higher insurance costs to court dockets bloated with opportunities looking to hit it big.

Now the U.S. House of Representatives is considering legislation that would restore some common sense to our legal process. H.R. 956 would limit punitive-damage awards in all types of cases to three times a person's economic losses or $250,000, whichever is greater.

This makes sense when you consider that punitive damages are over and above a person's out-of-pocket expenses (lost wages, medical bills) and are awarded for pain and suffering, emotional distress and the like. I believe this practical approach would make sure that people like you and me receive justice in our nation's courts.
