CITY COUNCIL ACTIONS PORTSMOUTH

The City Council took the following actions at its public hearing Monday:

Code Amendment: An amendment to zoning ordinance Article IV Historical Districts by adding ``restaurants'' to Historic Limited Office districts with use permits.

Deferred to June 12

Code Amendment: An amendment to zoning ordinance Article IV Historical Districts creating a Historic Limited Business 1 and Historic Limited Business 2 zoning districts.

Deferred to June 12

Olde Towne Neighborhood: Rezoning application by the City Planning Commission for property generally bounded by Court Street, Queen Street, Washington Street and London Boulevard from Historic Limited Office to Historic Limited Business 1.

Referred back to Planning Commission.

Northside Neighborhood: Rezoning application by the Portsmouth Elks Lodge for property at 300 Williamsburg Avenue from Office Residential OR-75 to Commercial C-2-K Conditional.

Deferred to May 23.

Highlands Neighborhood: Request of Hasan Peynircioglu for a use permit to operate a flea market at 3126 Victory Boulevard.

Approved, 7-0

Downtown Neighborhood: Request of Jakelynn E. Murphy to operate a school at 435 Washington Street.

Application withdrawn.

Comprehensive Plan Amendment: Churchland Neighborhood: An amendment to the land use plan of the city recommending Parks and Open Space at 4510 Twin Pines Road (Borrow Pit site). Other sections of the plan including, but not limited to the Parks and Open Space.

The City Council took the following actions at its meeting Tuesday (Robinett absent):

Public Hearing to consider an ordinance authorizing the city to enter into a Guaranty Agreement with the Hampton Roads Regional Jail Authority and the city of Norfolk, the city of Newport News and the city of Hampton on connection with the issuance by the Authority of its Note which it plans to issue in an amount not to exceed $7,000,000 to finance a portion of the costs of the architectural, engineering and other project development expenses of a regional jail for the cities of Portsmouth, Norfolk, Newport News and Hampton and further authorizing the Authority to purchase the land upon which the project will be constructed in the city of Portsmouth for the amount of approximately $2,000,000.

Resolution granting the use permit application of Hampton Roads Regional Jail Authority for a regional jail facility on properties bounded by Adamson Street, Elmhurst Lane, Ballard Avenues and Duncan Street.

Approved, 5-1; Clemons opposed.

Ordinance to appropriate $106,000 from the Capital Improvements Fund for construction of a soccer/Little League complex adjacent to John Tyler Elementary School/Hunt Mapp Middle School. The soccer/Little League complex will require extensive grading, fencing and utility preparation.

Approved, 6-0

Ordinance to guarantee $1,540,000 from the city's pro rata share of the Regional Jail Authority's debt.

Approved, 5-1; Clemons opposed.

Motion authorizing the city manager to enter into a Guaranty Agreement with the participating jurisdictions of the Hampton Roads Regional Jail Authority.

Approved, 5-1; Clemons opposed.

Ordinance amending the Portsmouth Supplemental Retirement System to include a provision permitting retirement at age 50 with at least 10 years of service. This provision will provide members of the PSRS with the same benefit that the General Assembly has afforded the members of the Virginia Retirement System (VRS), and is cost neutral to the PSRS.

Approved, 6-0

Ordinance to implement the new classification and pay plan. This plan includes the new market-based pay system and a salary adjustment for all employees currently earning less than the minimum of the new range.

Approved, 5-1;

Clemons opposed.

Motion to transfer $27,000 from the Grants Contingency Account for the Museums for Visual and Performing Arts activities. The Business Consortium for Arts Support recently awarded the Portsmouth Museums Arts Center a grant to defray the cost of six art exhibits. No local cash match is required.

Approved, 6-0

Motion to award a construction contract in the amount of $39,630 to CPG, Inc. to design, construct and test the Stormwater Best Management Practice (BMP). Funds were previously appropriated for this project, no appropriation is necessary.

Approved, 6-0

Motion to award a construction contract in the amount of $29,275 to Hayes, Seay, Mattern and Mattern to review and analyze the indoor air quality of Churchland High School. Concerns have arisen with respect to the ventilation system at Churchland High School. Funds for this contract are available from prior appropriations and no appropriation is necessary at this time.

Approved, 6-0

Motion to award a construction contract to Geo Design Consultants in the amount of $15,000 for monitoring the cleaning and painting of the steel superstructure on the two westbound lanes of the Churchland Bridge. Funds were previously appropriated for this project, no appropriation is necessary.
