PEDESTRIAN INJURED

A 39-year-old Nags Head man was in satisfactory condition at Sentara Norfolk General Hospital on Monday after being struck by an automobile on the Outer Banks late Saturday night.

Kevin Ray Herbin of Harbour Road in Nags Head was crossing U.S. Route 158 bypass with two friends when a 1991 Ford Explorer struck him.

Herbin, who was crossing the five-lane highway in front of Kelly's Restaurant, suffered a fractured pelvis, bruises and scrapes after being hit by the Explorer's front passenger side.

The driver, Michael Joseph Fox, 33, of Newport News, was not hurt. No charges were filed. There was no evidence that drugs, alcohol or speed was involved, police said.

``It was just an accident. It was dark. The guy had on dark clothing. There weren't any street lights or crosswalks nearby,'' Nags Head Deputy Police Chief Roy Byrum said. ``The driver just didn't see him.''

Traffic was stalled for about an hour as rescue workers and police cleared the scene.
