It all comes down to the word of Drug Enforcement Agent Don Lincoln.
Though Lincoln HAD said he specifically told Fulcher there wasn't enough marijuana involved to justify a federal investigation, Lincoln changed his tune after Fulcher was convicted.
Lincoln wrote the judge, saying he may have led Fulcher to believe he wanted the inmate's help.
Prosecutors then turned on their own agent, suggesting the Fulchers must "have something" on Lincoln, and that they blackmailed him into recanting.
Judge Jackson Kiser says: Lincoln "stuck his neck out" by writing the letter, saying it "enhances Lincoln's credibility."
