Ben Lilly and his attorneys fought hard to get a second trial for the 1995 murder of a Virginia Tech student.
They took the case all the way to the U.S. Supreme Court, and won.
But now it appears they may be able to skirt the death penalty by plea bargaining.

One person has tested positive for the Norwalk virus after eating at Steak and Ale in Roanoke County. The virus can be transmitted through food, and it can cause stomach and intestinal discomfort.

Lab results for 14 people came back this afternoon.
Some 70 customers reported food poisoning after eating there March 22nd, 23rd and 24th.
Health Department officials say more tests are being sent out and others still have not been returned.
Over the weekend Steak and Ale trained its employees on food safety and replaced all of its food.
The restaurant reopened for business Monday after voluntarily closing down.

The King of strock car racing's role model passed today, as 86 year old Lee Petty died in a Greensboro hospital.

One of Lee's last public appearances took place last April when he joined the rest of the Petty clan at the homeplace in Level Cross, North Carolina to kick off the 50th anniversary celebration for Petty Enterprises. Lee founded that organization in 1949 and turned it into the winningest company in American Motorsports. As a driver, Lee Petty won three Winston Cup championships and he was the winner of the first ever Daytona 500 in 1959. Petty, driving in the car number 42 won that race by a yard. Petty's career in effect came to an end two years later after he was involved in a bad accident. He then dedicated his efforts to his son Richard's career. Lee Petty was 86 years old.
