Andy Nicely was told last month that his voter registration was being transferred from Vinton to Roanoke, after someone had challenged Nicely's right to vote in Vinton.
He owns property in Vinton, but his HOUSE is in Roanoke, according to the County registrar.
A Circuit Judge has ruled that the registrar didn't give Nicely "timely notice" of the transfer.
If Nicely defeats Councilman Don Davis-- who's name IS on the ballot-- someone is sure to challenge the outcome.

Registrar Diane St. John says she plans to pursue it no matter who wins.

By a four to three vote, the board of supervisors approved a 93-million dollar budget that includes a 12-cent tax increase.
That would add about sixty dollars to the tax bill on a 50- thousand dollar home.
12 and a half million dollars will go to county schools-- that's a million and a half more than last year.

State inspectors could find no record that kids received their medicine.
