Elian Gonzalez could be back in Cuba by next Wednesday.

As Lee Cowan reports, the Miami Family can now appeal to the U-S Supreme Court.

(( Enough is enough.
That's the feeling of the full 11th circuit court of appeals in Atlanta that refused to hear any more about the Elian Gonzales custody dispute. And THAT could be the deciding blow in this long and bitter fight.

Elilan's Miami relatives have only one venue left: the US Supreme Court. They must hastily prepare thier appeal within FIVE days, but former immigration officials say it may be a waste of time. PAUL VIRTUE, FORMER INS LEGAL COUNSEL: "I don't see any basis in the 11th Circuit decision for the Supreme Court to want to entertain it."
If it did, the Court would have to issue a new order keeping Elian in the country while it considers taking the case. That could stretch Elians' stay well past the patience of his father, who for the first time since arriving here nearly 3 months ago, can now begin booking a flight back home as early as Wednesday. GREGORY CRAIG, ATTORNEY FOR ELIAN'S FATHER:
By refusing to re-hear the case, the court's earlier ruling stands: that Elian is too young to ask for asylum on his own -- and that the INS was right to decide that only his father should make such a request.
It is the fifth legal setback for the Miami relatives who've been trying for months to keep Elian in the US permanently. They've admitted to an uphill battle-- ever since Elian was seized by government agents in April. Now there is only one hill left -- and the clock is ticking faster than it ever has before. "If everything goes the way Elian's father hopes, the 6 year old who arrived on Thanksgiving Day, could be home before the 4th of July
