After arguing for eight hours a Botetourt County jury deliberating a murder trial has given up.
Members could not agree if a man who killed his brother was guilty of a crime.

Roger Broughman says he had to shoot his brother in self-defense after Rocky reached for a gun in his back pocket.
But Roger chose to drive up to Rocky's house in the first place, knowing Rocky wanted to kill him -- so most of the jury wanted to convict Roger of manslaughter.

After an eleven hour standoff- the suspect is in custody formally charged- no one was hurt.
Police say Bismark Rodriguez held his four year old and a room service waiter captive at a Hotel on Disney property-
Rodriguez told a Florida T-V station he was going through a divorce and he had not been able to see his other three children- and speak with his wife.
Authorities say Rodriguez' wife used to work at the Hotel- Police found her at an abuse shelter nearby.

A fired New River Castings employee says his former employer's added insult to injury.

David Gravely (GRAV-lee) almost died in an accident at the plant last June, when a 900-pound machine fell on him and crushed his back.
Intermet was cited and fined 196-thousand dollars by the labor department for the accident.
(Grav-lee's) Gravely's been on disability leave ever since.
His doctors told him he could NOT go back to work.
So when he found out this week that he was fired because he hadn't been to work, he was incensed.

The company's contract with its workers' union allows it to fire anyone who's out of work from injury for two years OR longer than the length of their employment.
Intermet says Gravely only worked for nine months before his accident.
He still receives worker's compensation.

Montgomery County Sheriff's Department has rolled out a new bike patrol unit.

Deputies will ride Huckleberry Trail several days a week from now on.
It's part of a community policing effort on the six-mile trail that runs through Blacksburg and Christiansburg.
Deputies say that there have been NO major crimes on the trail ... but that they started the bike patrol as a precaution.

The maker of an experimental drug for impotence has decided not to seek government approval at this time.
TAP Pharmaceuticals says it wants to do more studies on Uprima (yoo-PREE'-ma).
One in 30 men who took the optimal dose either fainted or suffered severe low blood pressure.
Advisers to the Food and Drug Administration had recommended the drug be sold with strong warnings, even though some advisers believed (you-prema) Uprima could kill.
Today was the deadline for the F-D-A to decide its fate.
But the company pulled its application, apparently fearing rejection.
However, TAP says it believes Uprima is effective and will seek F-D-A approval at a later date.

Today during an afternoon press conference, Guthridge resigned his position as the Tar Heels head coach.
The 62 year old Guthridge spent three seasons as head of the Carolina program after moving up the bench when Dean Smith retired. He led the Tar Heels to final four appearances his first two years at the helm.

The associated press is reporting today that Kansas Coach Roy Williams is leaving the Jayhawks to replace Guthridge at Carolina.
Williams was a former tar heel assistant under Dean Smith and he still has close ties to the University.
Williams would not comment on his leaving Kansas but the University has scheduled a news conference for this evening at 8 oclock.
