The Town passed an ordinance last year, prohibiting N-S from sounding train whistles at night.
The railroad sued. As of today the two sides have settled the dispute, based on proposed regulations for railroad- track crossing warnings.
The new regs have not actually taken effect yet, but the promise of new warning devices in Marion and across the nation may make this a moot point and helped settle the case.
