This morning the chief federal judge for Western Virginia refused to block the execution.
Sam Wilson found that Akers' court- appointed attorney doesn't have "standing" to raise the issue of competency over his client's objections.
Late today the Federal Appeals Court in Richmond agreed with that determination.
The case is now before the U-S Supreme Court.

For more than 40 years, Robinson and his wife Jeanne have been publishing hometown newspapers.
Until yesterday, the Robinsons owned the Salem Times Register, New Castle Record, Fincastle Herald, and Vinton Messenger.
