In papers filed today they said - U.S. District Court Judge Richard Matsch who refused yesterday's stay - let emotions cloud his judgment and "succumbed to the human tragedy of the OK City bombing." Defense Attorney Christopher Tritico: "Our hope is that the 10th Circuit will see what we were asking for yesterday that Judge Matsch did not." McVeigh, is watching the clock tick from his death row jail cell in Terre Haute's federal prison. Defense Attorney Nathan Chambers: He is well, he is aware that the appeal has been filed in the 10th circuit of appeals. The defense team contends that Judge Matsch used the wrong standard when ruling the execution should proceed. The heart of their argument is that they need more time to digest the more than 4,500 documents they received just five days before McVeigh's initial execution date.
Defense Attorney Christopher Tritico "If at the conclusion of the process after we get more time, Mr. Mcveigh is still executed we know the system worked. If at the conclusion of the process Mr.McVeigh is given relief in the form of a new punishment hearing, then the system still worked." The process could carry as far as the U.S. Supreme Court if the 10th Circuit Court reject the latest round of appeals, setting the stage for what could be a showdown in the high court. ))

Authorities alleged Kirby had been working as a prostitute using another name at the time of the murder.

Last summer Virginia Beach outlawed cursing - This year, it's tattooing and piercing by the opposite sex. That's right -- it's now illegal in Virginia Beach for a man to tattoo or pierce a woman's genitals, and vice versa. This law comes after testimony that a woman was abused while she was being pierced. The maximum punishment for breaking the law is a 25-hundred-dollar fine or a year in jail. The American Civil Liberties Union says there have been similar efforts to regulate the massage industry in the area.

Virginia Beach officials say the area's image can be damaged by tattoo and piercing parlors.

Fiber Optic Cable... could it be coming to a railroad track near you?

A Norfolk Southern subsidiary called "T-Cubed" got the go-ahead from the courts to install fiber optic cable in 15 states, including Virginia.
About 60 thousand property owners could get thirty one thousand dollars for every mile of cable laid through their property. [PRE PRO]
In pink you can see cable is already being laid along side railroad track from Chicago to Northern Virginia.
In blue is a route under development that may pass through Lynchburg.
N-S says there are no immediate plans to lay cable in Roanoke, but you can see in green that the possibility does exist.
