A 12-year old missing person investigation has now turned into a murder case.

On Monday-- a dive team searching Philpott Lake in Patrick County discovered a body inside a barrel. Investigators originally thought it was that of a missing Nelson County man. But an autopsy yesterday determined the remains to be that of Ether Adean Smith. The 38- year old Martinsville woman vanished nearly 12- years ago.

Lightning is being blamed for a fire in Rockbridge County that has consumed about 300 acres.

The blaze was found late Sunday night in a remote location near Adams Peak.
The flames are in extremely treacherous terrain.
50-firefighters are working to put the fire out, but they must walk nearly two hours to get to the blaze.
Recreation areas including the Appalachian Trail and Blue Ridge Parkway are not affected by the fire.
Officials say containing the fire depends on the weather, but it could take anywhere from two to seven days.

Keeping kids off tobacco is the focus of a 30-million dollar ad campaign in Virginia.

But the Richmond agency, awarded the contract yesterday by the Virginia Tobacco Settlement Foundation, is best known for plugging a locally brewed beer.
The money for the campaign comes from ten percent of the state's share of the Master Settlement Agreement with tobacco companies.
That's the portion Governor Jim Gilmore chose to set aside for health concerns.

Pilots based at Comair's OTHER hub in Orlando begin voting today.

Christopher Haynes' attorney wants to know if prosecutors are seeking an indictment for capital murder.

Haynes is accused of killing 20-year old Tina Foster.
The Hooters waitress disappeared in late January, and her body was later found in her car outside a Roanoke motel.
Haynes' attorney says prosecutors have considered a direct indictment for attempted rape and capital murder, and Wayne Inge (Inj) says his client needs to know how prosecutors will proceed.

Chief Deputy Commonwealth's Attorney Betty Jo Anthony says prosecutors won't decide on any additional charges until they've evaluated all of the evidence in the case, including lab tests that are still incomplete.
A judge has agreed to hear arguments on the issue next week.

A state trooper was involved in an accident last night during a pursuit on Windy Gap Mountain in Roanoke County.

Officials say Trooper M-C Brown, Junior was chasing a motorcycle on Route 116.
Brown lost control, sideswiped a pickup truck coming the other direction, and crashed.
State police did NOT have specific information on Brown's condition, but say he did NOT have to be admitted to a hospital.
The driver of the pickup was not injured.
The person on the motorcycle got away.
