A 12-year old missing person investigation has now turned into a murder case.
On Monday-- a dive team searching Philpott Lake in Patrick County discovered a body inside a barrel.
Investigators originally thought it was that of a missing Nelson County man.
But an autopsy yesterday determined the remains to be that of Ether Adean Smith.
The 38- year old Martinsville woman vanished nearly 12- years ago.

Lightning is being blamed for a fire in Rockbridge County that has consumed about 300 acres.
The blaze was found late Sunday night in a remote location near Adams Peak.
The flames are in extremely treacherous terrain.
50-firefighters are working to put the fire out, but they must walk nearly two hours to get to the blaze.
Recreation areas including the Appalachian Trail and Blue Ridge Parkway are not affected by the fire.
Officials say containing the fire depends on the weather, but it could take anywhere from two to seven days.
Virginia's Fourth District congressional seat goes to the G-O-P.
That's because Republican Randy Forbes won yesterday's special election.
Forbes took 52 percent of the votes,
Democrat Louise Lucas lagged behind with 48 percent in the Petersburg-Area district.
The state senator succeeds Norman Sisisky, a Democrat who died in March.
Some political analysts say the race will be viewed as an early referendum on the Bush administration and as a bellwether for next year's midterm elections.
Good morning, I'm Kimberly McBroom - Another hot day is on the way with partly sunny skies and highs nearing 90. Meteorologist Leo Hirsbrunner has your complete forecast coming up. But first -
Keeping kids off tobacco is the focus of a 30-million dollar ad campaign in Virginia.
But the Richmond agency, awarded the contract yesterday by the Virginia Tobacco Settlement Foundation, is best known for plugging a locally brewed beer.
The money for the campaign comes from ten percent of the state's share of the Master Settlement Agreement with tobacco companies.
That's the portion Governor Jim Gilmore chose to set aside for health concerns.
[IN Q=I think our target audience]
((SEN. EMMETT HANGER/R-AUGUSTA CO.: I THINK OUR TARGET AUDIENCE IS GOING TO BE A LITTLE YOUNGER THAN YOU MIGHT EXPECT -- MAYBE THE TWEENS, THOSE THAT ARE JUST APPROACHING THE MIDDLE SCHOOL YEARS WHERE'S THERE'S A LOT OF PRESSURE TO TRY THESE NEW THINGS. AND WHERE THE 9, 10, 11, 12 YEAR OLDS ARE BASICALLY FORMING HABITS UNFORTUNATELY AT THAT TIME WHICH CAN BECOME ADDICTIVE.))

Delta Connection regional jets operated by Atlantic Southeast Airlines will fly in and out every day until October 31st -- the end of the resort's peak season.
Greenbrier Resort's president says he hopes the service will allow guests more time to enjoy resort activities.
For those who suffer from severe acne --the drug Accutane is often their only hope.
But it comes with a serious side effect -- it may cause mental problems and even suicide.
That's why the F-D-A is now requiring all patients to sign an informed consent form to take Accutane.
Part of that form reads that some patients have had thoughts of hurting themselves or putting an end to their own lives.
The F-D-A says no one knows for sure that the Accutane causes depression. But patients should be aware of the risk.

Christopher Haynes' attorney wants to know if prosecutors are seeking an indictment for capital murder.
Haynes is accused of killing 20-year old Tina Foster.
The Hooters waitress disappeared in late January, and her body was later found in her car outside a Roanoke motel.
Haynes' attorney says prosecutors have considered a direct indictment for attempted rape and capital murder, and Wayne Inge (Inj) says his client needs to know how prosecutors will proceed.

Chief Deputy Commonwealth's Attorney Betty Jo Anthony says prosecutors won't decide on any additional charges until they've evaluated all of the evidence in the case, including lab tests that are still incomplete.

A state trooper was involved in an accident last night during a pursuit on Windy Gap Mountain in Roanoke County.
Officials say Trooper M-C Brown, Junior was chasing a motorcycle on Route 116.
Brown lost control, sideswiped a pickup truck coming the other direction, and crashed.
State police did NOT have specific information on Brown's condition, but say he did NOT have to be admitted to a hospital.
The driver of the pickup was not injured.
The person on the motorcycle got away.
Education is a big issue for this year's gubernatorial candidates.
Republican candidate Mark Earley announced yesterday his agenda for improving public education in Virginia.
Earley wants to reduce class sizes, provide more mentors and raise teachers' salaries.
Democrats point out that Earley supported Governor Gilmore's budget that did "not" fund teacher pay raises.
