Just moments ago a federal appeals court handed software giant Microsoft a major victory.

The court reversed the breakup of Microsoft as it ordered that a new judge decide the case.
The appeals court ruled that judge Thomas Penfield Jackson improperly conducted himself in the case. The court says he left himself open to the appearance that he was biased against Microsoft. In its ruling, the court accuses Jackson of ``holding secret interviews with members of the media.''

It also says he ``made numerous offensive comments about Microsoft officials in public statements outside of the courtroom.''

19- year- old Erina McGuckin testified her family lived in a house without running water, and with little or no heat.
Erina left home a year ago to join the Navy.
A magistrate is trying to decide whether her mother, JoAnn McGuckin should stand trial for child neglect.
It was McGuckin's arrest that led to six of her children holding a five- day standoff with police at their ramshackle home in the woods.
McGuckin's been in jail since May 29th.

The battle over the state budget has produced some good news for potential medicaid patients.
A whole new group of elderly or disabled Virginians will be eligible for coverage July first -- because lawmakers fought to keep it in the budget last year.

(( Even though the federal government reimburses states 50 percent of Medicaid costs, Virginia has only covered those senior or disabled people who make 37 percent or less BELOW the poverty level.
In four days, the bar is raised to allow those who make 80 percent to be covered.
That's still only 573 dollars a month for an individual-- not much to dance about.

So the Virginia Alliance for the Mentally Ill is trying to get the word out.
Republican Delegate Phil Hamilton of Newport News goes as far as saying he doesn't think the Gilmore administration is going to work very hard to tell Virginians they may now qualify.
And Hamilton says the good Medicaid news should NOT fool people into believing cuts to mental health aren't still coming from Governor Jim Gilmore -- as he scrambles to balance the budget and pay for the car tax cut.
Hamilton says he expects the cuts to be announced as Gilmore leaves office in January.

Right now Roanoke and heading south through the New River Valley, temperatures are up to 82. Martinsville is already heating up to a high 88 dgrees. And the mountains of West Virginia are lagging behind with temperatures in the low seventies. Relatives of Ben Carr are upset attorneys for Earl Bramblett have labeled the deceased postal employee an "alternate suspect" in the murders of a Vinton family.

At the very least, they say, the prosecutor should have alerted the defense that Carr had said he'd "killed people for a lot less."
Carr's 30-year old son concedes Ben might have said such a thing, but he refuses to believe his father was involved.

(NAT - reporters) As James Kopp arrived at the French Court of Appeal,

he surprisingly responded to reporters questions about the murder of abortion doctor Bernard Slepian.

Who killed Doctor Slepian? Thats the only question you should ask.
At the court hearing, a 3-judge panel recommended Kopp should be extradited to the United States to face the murder charges - with some restrictions.

The Court of Appeal has only said yes to the federal extradition application because the American authorities have promised there will be no death penalty.
In 1981, France abolished capital punishment and does not extradite suspects who face the death penalty at home.
Kopp could have been a candidate. He was one of the FBIs most wanted fugitives before he was caught - wanted for the 1998 sniper-style murder of Slepian - a New York doctor who performed abortions.
The murder happened at Slepians home. Police believe Kopp was positioned outside near a tree when he fired shots through a window -- killing the doctor.

He's a six- foot, eleven- inch 240- pound kid who just graduated from high school. Never before has a high school player been the top pick. In fact high school kids were taken with 4 of the first 8 picks. Oak Hill's DeSagana Diop (JOP) ironically went to the Cavaliers - the Cleveland Cavs with the 8th pick. Duke's Shane Battier slipped a bit, going 6th to the Vancouver Grizzlies. North Carolina's Brendan Haywood went 20th to the Cavs, but he was then traded to the Magic. And fellow-Tarheel Joseph Forte was selected by the Celtics with the 21st pick.

The National Basketball Developmental League leaders will be back in Roanoke today to announce that Kent Davidson is the Star City team's first head coach. Davidson is a former coach in both the CBA and USBL. He spent last season as the coach of the Dodge City Legend. Yesterday afternoon the Columbus, Georgia team named Jeff Malone its head coach. The Georgia native played 13 years in the NBA, spending most of his time with Bullets in the 80's.
