Another new driving law goes into effect today... this one - affects those charged with drinking and driving. Judges and juries in Virginia WILL be informed when a defendant refuses to take a breathalyzer test. But the law also instructs judges and juries not to consider their refusal as evidence of guilt. Defense lawyers contend the law is unfair and irrelevant as to whether a driver was truly intoxicated when pulled over.
