Day says his re-drawn political district is the primary reason he's stepping aside.
The plan approved this spring lumps Day into a new House district with fellow Democrats Tom Jackson and Ward Armstrong.
Day says he's trying to "take the high road" by deferring to the "more senior" lawmakers in his new district.
Jackson and Armstrong have yet to announce if they will run against each other in a Democratic primary.

Two teens are in critical condition after a church van from Roanoke overturned on Route 220 near Greensboro yesterday afternoon.
The van was on its way back to Virginia Heights Baptist Church after a weekend retreat in Myrtle Beach.

Two other teens are still hospitalized but are expected to make a full recovery.

Altogether, 14 passengers were in the van when it blew its left rear tire on northbound Route 220 near Level Cross.
The North Carolina Highway Patrol says the van lost control and flipped several times.
11 people were injured with several students thrown from the vehicle.
Family members have gathered at Moses Cone Memorial Hospital in Greensboro to keep vigil.

Vans like the one in yesterday's accident have been linked to several accidents and deaths in the past year. And warnings have been issued about the dangers involved in using the 15 passenger vans.

According to a Federal Agency, since December of 1999, 5 deaths and 45 injuries, many of which were reported as critical, were linked to this particular type of van. Operators of the vehicles say there are precautions which should be taken, even though they're not required by law.

This, coupled with safe, experienced drivers, the proper use of seat belts, and a safe speed decreases the likelihood of an accident. Many owners are unaware of the risks involved despite a warning issued by the Department of Transportation in April. These vans are commonly used by churches, colleges and other organizations.

Chicco U-S-A is voluntarily recalling about 6-thousand Build- A ball Preschool toys.
If the ball is used improperly it could cause a child to suffocate.
The recall was sparked by a recent incident. A two year old was playing with the toy when an adult found him with the ball stuck on his face, covering his nose and mouth.
The child is all right... but the toys are being recalled.

The arrest warrant is unprecedented in Okinawa making him the first U-S Serviceman on the island turned over to the Japanese.. BEFORE the filing of formal charges.
Police identified the suspect as Timothy Woodland... a 24 year old staff sergeant. He's accused of raping a woman against the side of a car in a parking lot in a trendy tourist area.
The case has renewed anger over the heavy presence of U-S troops on the island.

It was "blocked up" in 1971 when the track was abandoned.

Authorities have located a borrowed Mitsubishi in Franklin County.
But so far, police say, there's still no sign of Jennifer Barker or the man police believe she may be with, Dewy Summerlin.

Barker disappeared Thursday morning- -around the time she usual reports to work at the Main Post Office in Roanoke.
Her car was left on the street near the mail truck she drives.

City police say the car has turned up, but aren't saying where exactly.
