Laws are getting a little tougher for anyone charged with drinking and driving. A new law went into effect yesterday - allowing judges and juries in Virginia to be informed when a defendant REFUSES to take a breathalyzer test. But the law also instructs judges and juries not to consider their refusal as evidence of guilt. Defense lawyers contend the law is unfair and irrelevant as to whether a driver was truly intoxicated when pulled over.
