The owner of a Henry County sewage treatment plant has agreed to plead guilty to "negligent discharge of pollutants."

The government charges Richard Myron Anthony allowed untreated sewage to enter the Blackberry Creek during a three- week period in September of 1999.
Anthony had tried to transfer the plant to the local public service authority. Eventually he quit paying the electric bill and A-E-P turned the power off. Without aeration, the creek developed extremely high levels of fecal coliform.
The treatment plant had been built to process waste water from Fairway Acres.
Anthony faces a fine of up to 25-thousand dollars- a- day for every day the treatment plant wasn't working properly.
