City Council and the mayor want to capture the nearly one and half million dollars in annual hotel-motel taxes from the posh resort.
The Greenbrier filed two lawsuits seeking to stop the vote.
Its lawyers argue that City Council violated the state's "open meetings law" when it voted February Eleventh to hold the annexation vote without proper public notice or debate.
They also contend West Virginia's annexation laws are unconstitutional.
The town's lawyers say The Greenbrier agreed not to pursue the lawsuits until council decides whether to reschedule the vote.
