((It's a case that rocked the New York City Police Department - and now -- yet another twist in the brutal assault of Abner Louima.
Citing insufficient evidence, the 2nd Circuit Court of Appeals has overturned the convictions of 3 police officers accused of taking part in the attack; Charles Schwarz, Thomas Wiese, (WEESE) and Thomas Bruder.

(SOT - ) Al Sharpton -- Activist

"This could mean that they have let these people walk in one of the ugliest most pathetic and certainly sick crimes that we've seen in the history of this city."

(TRACK)

The ruling does not change the conviction of police officer Justin Volpe -- the chief attacker in the case. But it once again raises questions about who was really involved in the torture of the Haitian immigrant.
Prosecutors contended it was Schwarz who pinned down Louima in a police station bathroom in 1997, while Volpe sodomized him with a broken broomstick. But after Volpe pled guilty to the crime and was sentenced to 30 years, he told prosecutors Schwarz was never in the bathroom with him.

(use graphic here)

At the very least, Schwarz will now get a new trial -- with the appeals court saying he was denied effective counsel and the jury was improperly exposed to prejudicial information during deliberations.

(SOT - ) Ronald Fischetti -- Schwarz Attorney

"I'm ecstatic ... this is what we've been fighting for 2 and a half years ... Chuck was never in that bathroom ...An innocent man is now going to get bail and come home."

(TRACK)

Its not yet clear whether the Justice Department will retry any of the 3 men or if they will be set free. But there's no doubt how seriously injured Louima was as a result of the attack. After settling a lawsuit with the city and the police union, Louima received almost 9 million dollars and now lives in Florida. Gretchen Carlson, CBS News, New York.))
