The state Supreme Court overturned Thomas' capital conviction and death sentence.

He has spent the past year on death row for the attempted rape and murder of 16-year old Tara Munsey. But the Supreme Court says the trial judge failed to properly take into account the impact of pre-trial publicity. It was not just the extensive coverage the case generated. "The tenor of the publicity went beyond dispassionate reporting...." according to today's Supreme Court opinion. Justice Elizabeth Lacy cited specific stories. One in particular was a newspaper article that said police had tied the bullets to the suspect, when in fact the bullets could not be linked to Thomas. Judge Colin Gibb refused to move the trial out of Pulaski, believing he'd seated an impartial jury. But it hadn't been easy. It took five days to pick a jury. "...the more difficult it is to seat a jury," Justice Lacy says: "the more likely it is that the public will believe the judicial process to be tainted by prejudice."

Victims of a New River Valley explosion are filing suit in Radford Circuit Court.

An explosion at the New River Castings plant in Radford killed three-people and seriously injured others in March of 2000. Court documents list five-plaintiffs....the estates of the deceased and two injured employees. A 15-year old girl was fatally injured by rifle fire at his front door. His attorney had asked a judge to consider setting bond for Jamison today, but withdrew the request once he learned Jamison will likely be indicted Monday for murder.

His shoes caught fire immediately.
Two of his co-workers were able to put out the flames with a fire extinguisher.

Funny things were everywhere on this Read Across America Day, including lots of Cats in the Hat.
Parents, teachers and guests read their favorite books to the kids, and then passed out treats.
