The 32-year-old was granted a new trial by the Virginia Supreme Court.
Earlier this year, the court unanimously overturned his capital murder conviction and death sentence.
Thomas was convicted in a Pulaski Circuit Court last March of killing 16-year-old Tara Munsey.
But the state court said a change of venue should have been granted because of excessive publicity.
Thomas will remain jailed at the Sussex Correctional Center in Waverly until his second trial.
