The Minnesota Historical Society says it has no intention of returning to the Commonwealth a flag captured at the Batt

le of Gettysburg. The banner, with the "Southern Cross'' Confederate emblem, was taken in 1863.
Despite a Congressional ruling in 1905 that all flags be returned to their originating states, Minnesota hung onto it.

In 1998, then-Minnesota Attorney General Hubert Humphrey III turned down a request from a Virginia re-enactment group,

saying the law applied only to flags already in the Defense Department's possession. The Commonwealth would like the flag to be returned to the Defense Department for display at the National Museum of the United States Army to open in Fort Belvoir, Virginia.
