A Nashville record company says the "Clark Family Experience" filed bankruptcy for the sole purpose of escaping from its contract.
And Curb Records is asking the bankruptcy court to dismiss the petition.
(------------)
[VO-NAT]

The six Clark brothers have ties to Franklin County, and they recently filed for bankruptcy protection in Roanoke.
Signed to Curb Records in 1998, they're still waiting for *their* first album, now scheduled for release next month. The group maintains that it doesn't have enough income to meet its financial obligations.
But in a response filed this week, lawyers for Curb Records maintain the Clarks transferred assets before filing for bankruptcy protection, and overstated *their* debts.
Curb is asking the court to dismiss the Clarks' petitions, or transfer the cases to the bankruptcy court in Tennessee.
(------------)
[ANCHOR=JEan]
[GRAPHIC=None]

Today, one of the Clarks' attorneys said Curb's motion is without merit. Calvin Smith said testimony at the creditors meeting earlier this month made it clear that the brothers are not able to pay their debts.
A Bankruptcy Court judge will consider the case in September.
