((David Westerfield shook silently inside the courtroom, but outside it was anything but quiet as the jury delivered its verdict.
Guilty. Yeah! Alright!
Brenda Van Dam and her family hustled out of the courthouse without saying a word, after the jury convicted Westerfield on all charges. The six men and six women deliberated for nearly two weeks, and determined that Westerfield kidnapped and killed 7-year old Danielle van Dam.
Were these, and are these, your verdicts as read?
Yes, yes, yes.
Danielle s father put her to bed February 1st, and never saw her again. The defense argued there was no physical evidence linking Westerfield to the family's home. And they criticized Danielle s parents, saying they smoked dope and invited sex partners home on the
night their daughter disappeared.
Danielle's blood is on that jacket.
Prosecutors said Westerfield s jacket was only part of the DNA evidence. Detectives found Danielle's fingerprints and hair on Westerfield s bed and in between his sheets. And in an emotional closing argument, Jeff Dusek asked the jury to imagine if Danielle herself could somehow let them know who killed her.
JEFF DUSEK/PROSECUTOR:
I've already told you, with my hair and where you found it. Orange fiber on my clothes and where you
found it. And with my fingerprints. And I ve told you with my blood.
Westerfield headed back to jail ... where he will wait for next Wednesday's penalty phase. That's when the same jury will decide if he should die for these crimes.
CHRIS LAWRENCE/CBS NEWS:
Until then , don't expect to hear anything from the prosecution or the defense about the verdict. A gag order remains in effect for both sides.
