Maryland prosecutors say the issue is clear cut. They say because most of the murders occurred in that state and the investigation was centered in Montgomery County, Maryland, the suspects should be charged there.
But a big factor is in what jurisdiction prosecutors will most likely win a death penalty conviction.
Maryland has the death penalty- but not for Juveniles. In Virginia, where five of the shootings took place the death penalty is available for adults and children.
And to make matters more complicated federal prosecutors are also considering charging the suspects.
