Voters are being asked to approve a measure to permit the state Supreme Court to free an innocent person based on DNA testing.
The proposed Constitutional amendment would create an exemption to the 21-day-rule for new DNA evidence.
Virginia's 21-day-rule limits the introduction of new evidence to a three-week period following a conviction.
It is the most restrictive limit in the nation.
Supporters says the measure is needed to prevent innocent people from spending their lives in prison for something they didn't do.
