Virginia has the laws and the penalties- and therefore VIRGINIA will get the first crack at prosecuting sniper suspects- John Allen Muhammed and John Lee Malvo.
The Justice department today dismissed its charges against the two suspected serial snipers- That paves the way for state prosecutors to take the case first.

BUT THE KILLING SPREE APPEARS TO HAVE NETTED YET ANOTHER VICTIM.
POLICE IN ATLANTA SAY 42-YEAR-OLD MILLION WOLDEMARIAN WAS FATALLY SHOT
OUTSIDE THE LIQUOR STORE HE WORKED AT ON SEPTEMBER 21ST. IT TOOK PLACE
THE SAME DAY. LATER THAT DAY, A WOMAN WAS ALSO KILLED IN MONTGOMERY,
ALABAMA AND POLICE ARE LINKING THE TWO.

Police say a man shot his wife and son in the school parking lot- killing the boy.
This happened at the St. James Catholic School in Liberty- where children from kindergarten through eigth grade attend school.
A spokeswoman for the Roman Catholic Diocese says it is unlikely any students saw the shooting.
The students were sent to a nearby site where their parents picked them up-
Police caught up with the suspect about 20 miles away in Kansas City.
