Brightwell wounded Michael Scott Peery (perry) on December 17th in a parking lot on Apperson Drive.
Police said the incident unfolded as officers were trying to make an undercover drug buy.
King said it was proper for Brightwell to draw his gun. He said Peery refused to obey the officer and tried to run.
And the prosecutor found that Brightwell's gun discharged accidentally, when Peery struck the weapon.
Brightwell has been on administrative leave since the shooting. He returned to full duty yesterday afternoon.
