Officials with the International Association of Machinists Local 165 say Norfolk Southern is using unfair trade practices, and is in violation of the Railway Labor Act. A company spokesperson says the dispute stems from work done on locomotive fuel pumps by the manufacturer.
She says the pumps had a higher rate of failure than normal, and needed to be replaced under warranty by the manufacturer, instead of local machinists. A temporary injunction against the union was issued this morning in U-S District Court, forcing the striking workers back to work. Machinists at Norfolk Southern have been without a contract for nearly three years.
The company and union are currently negotiating a deal.

Meanwhile, investigators won a race against the lava, which got to within 50 feet of the wreckage before crews were able to remove it.
The Kilauea (kill-UH-way-uh) Volcano attracts thousands of visitors every year, who are eager to get a glimpse of the lava that's been flowing for more than 20 years.

((Embattled Bishop Thomas O'brien finds himself once again answering to another higher authority today--The Arizona Legal System. Phoenix Prosecutors charged the 67-year old spiritual leader with leaving the scene of a fatal accident. 43-year-old Jim Reed was killed Saturday night while jaywalking.

(SOT Veronica Dergera/Victim's Neighbor )

"WE ARE JUST SHOCKED, WE COULD NOT BELIEVE THAT HE DIED."
Witnesseses say two cars hit Reed....but so far police have located only one of the vehicles...Father O'brien's. They found it at his house yesterday--the windshield was smashed. O'Brien told police he was returning home from Mass Saturday night when he thought he hit an animal.

(SOT COMMANDER GLEN GARDNER/PHOENIX POLICE)

"SO ONE OF THE QUESTIONS WE ARE LOOKING INTO IS HOW THAT KIND OF COLLISION COULD HAVE OCCURRED WITHOUT SOMEBODY STOPPING AND AT LEAST WANTING TO INVESTIGATE WHAT THEY HAD STRUCK."

(NATSOUND BISHOP IN CHURCH)

(Drew Levinson)

FOR THE CATHOLIC CHURCH--THIS IS JUST ANOTHER PROBLEM IT MUST DEAL WITH. THE MORAL CHARACTER AND AUTHORITY OF SEVERAL BISHOPS HAVE BEEN CALLED INTO QUESTION--AFTER THEY'VE ADMITTED TO SEXUAL MISCONDUCT AND COVERUPS.
And for O'Brien, this is his second bout with the law in a matter of weeks. Prosecutors made a deal with O'Brien after he admitted he allowed priests to work with minors even though he knew of sexual misconduct allegations against them. And as some observors of the church have said it casts a darker shadow on the faith
Dale Hudson/Magazine Editor " WHICH IS UNFORTUNATE BECAUSE WE HAVE NEARLY 300 BISHIPS IN THIS COUNTRY, MANY GOOD MEN OUT THERE, MANY GREAT LEADERS."
And he adds...there's a perception out there that the Catholic Church is running from its problems...just as Bishop Thomas O'Brien, allegedly ran away from that hit and run accident. Drew Levinson, CBS News, New York. ))
