Judges from the Ninth Circuit Court of Appeals reinstated California's Gubernatorial recall election today.
The original October 7th date was upheld in a unanimous ruling.
The judges said the California Constitution requires the election go forward in a certain period of time.

A 15-year old from Salem faces murder and drug charges in the overdose death of another teenager.
The teenager is in custody but his name has not been released.
Salem police say he's charged with felony homicide and distribution of methadone in connection with the death of 18- year old Joseph Ryan Lawrence.
Lawrence and another 18 year old were taken to the hospital last May suffering from what police thought was a drug overdose.
Lawrence died at the hospital-- the other 18 year old later recovered.

Franklin County deputies arrested 50 people on charges of selling marijuana, cocaine and prescription drugs.
Six face federal charges as major suppliers of the drugs.
The bust is the second-biggest in Franklin County history.

U-S Senior Airman Ahmad Al Hal-Abi worked as an arabic translator at the Guantanamo Bay Prison camp in Cuba.
That's where al Qaeda and other terrorist suspects are held.

Al Hal-abi is the second military man facing charges- who worked at the prison.
Army Captain and Chaplain Yousef Yee was arrested after he was found carrying classified documents about prisoners and their interrogations.

Dale Earnhardt Junior is expected to race at Talladega Superspeedway this weekend even though NASCAR has not yet medically cleared him to compete. Earnhardt suffered a minor concussion and sprained right foot in a wreck Sunday in Dover, Delaware. He needs a doctor to approve he is fit to drive before he's allowed on the track.

Winston Cup drivers are at Talladega Sunday for the EA Sports 500. Racing legend Davey Allison died 10 years ago July in a helicopter accident. The Birmingham News paper quotes Allison's attorney today as saying that Davey's death was a result of a flawed part of the helicopter and NOT pilot error. Davey was steering the helicopter when it crashed.

Rumors flew that the two were applying for a marriage license.
Not so.... though says the local sheriff. Ben Affleck was just in asking about a gun permit.
The secretary who snapped this picture with the sheriff says the two are down to earth.
While J-Lo and Ben are not wed, it's obvious .. they are together. The two recently bought a waterfront house near Savannah.
