Affidavits allege KIK Virginia violated the Clean Water Act.
Earlier this month, investigators discovered the facility was discharging high levels of chlorine into both Salem's sewer system and the storm water collection system that leads to the Roanoke River.
The Environmental Protection Agency believes that contamination killed a number of fish in the river in late August.

If it is determined officials with KIK Virginia knew about the discharge, they could face up to three years in prison and a maximum fine of 50-thousand dollars for each day of the violation.
