The judge can either confirm the recommended sentence or reduce it- a step that is rarely taken.

Under the plan Virginia's sales tax would increase by a penny.
Smokers would pay 22 cents more for a pack of cigarettes.
And wealthy Virginians would see a higher tax bill.
Warner says his reform package will raise over 500 million dollars a year in additional revenue.
The plan also includes tax cuts.
The governor wants to trim the tax on groceries and complete the phaseout of the car tax.
The plan must first be approved by the General Assembly.

It would be the first major reform to Medicare since the giant health care program was created nearly four decades ago.

IT'S HERE AT THE PHARMACY WHERE SENIORS WOULD SEE THE DIFFERENCE, FIRST THE BILL PROVIDES PRESCRIPTION DRUG BENEFITS. IT ALSO GIVES FINANCIAL SUPPORT FOR THE ELDERLY WITH LOWER INCOMES.
And it provides subsidies to insurance companies. The plan for 40 million american's would kick in - in 2006.

"WE NEED THESE DRUGS FOR THE SENIORS OF THIS COUNTRY. THERE IS NO QUESTION IN MY MIND THAT WE DID THE RIGHT THING."
But there are plenty of AARP members - who are upset with their own organization. They say the plan won't cover all their prescription drug costs..and they'll be forced to pay more money than they should. And they claim it would force them into HMO's...because that's where the government will be allocating a lot of dollars.
