In fewer than 24 hours, James Reid was scheduled to die by lethal injection for the murder of 87 year old Annie Lester.

The U.S. fourth circuit court of Appeals in Richmond granted the stay of execution based on a recent Alabama case.
Even so, there is still a chance Reid could be executed as scheduled tomorrow.

This is not an issue of guilt or innocence.
James Reid admits he killed Annie Lester by strangling and stabbing her 22 times back in 1996.
The issue, his current lawyer says is whether Reid got fair representation from his original attorney.

So James Turk filed appeal after appeal in several different courts.
Tuesday afternoon, a federal court granted Reid's request for a delay pending a U.S. Supreme Court decision in a similar case.
It has to do with an Alabama death row inmate who has chosen lethal injection but has damaged veins that prevent an injection in the arm.
What the Supreme Court must decide in Nelson v. Campbell is whether that is cruel and unusual punishment.

Jerry Kilgore plans to ask the Supreme Court to overturn the 4th circuit's decision and continue the execution as scheduled.

The man who shot President Reagan and was acquitted by reason of insanity- can make unsupervised visits to his parents- AWAY from a mental hospital.
A federal judge made that ruling today.

((John Hinckley Jr. no longer poses a threat to himself or to others - that's the analysis from a doctor at the psychiatric hospital where Hinckley has been held for more than two decades. in Washington, DCTERMS. That kind of testimony, from hospital officials, prompted a federal judge to grant Hinckley unsupervised visits with his parents but only within a 50 mile radius of the hospital. It was March 1981 when Hinckley shot President Ronald Reagan and three others outside a Washington hotel. Hinckley said he shot the President to impress actress Jodi Foster. Hinckley was acquitted by reason of insanity and has spent the last 22 years at St. Elizabeths. Now hell be able to leave, but with some conditions. The 48 year-old won't need a hospital escort. He's been granted six local day trips and then two overnight visits. He wanted to go to his family home in Williamsburg, Virginia, but the judge said no. President Reagans family and the government continue to oppose Hinckley's request. Sarah Bradys husband Jim, Mr. Reagan's Press Secretary, was shot and paralyzed during the assassination attempt. She told the court she fears for their safety if Hinckley goes unsupervised. But when several psychiatrists said Hinckley's visits could actually make him less dangerous, it was enough to convince the judge to give the green light.))

That's the word from Centra Health, the company that operates Lynchburg General Hospital as well as Guggenheimer Nursing Home in Lynchburg and Fairmont Crossing in Amherst.
Centra Health is asking anyone with a cough, runny or stuffy nose and sore throat not to visit.
Meanwhile, two local health departments are getting some more flu vaccine.

The Roanoke City Health Department now has an additional hundred doses of the serum. But it's only available to those at high risk and on a first-come-first-served basis by appointment.
Lynchburg's Health Department has about 50 doses which it plans to give out at a clinic tomorrow starting at 8:30 a-m.
And if you're looking for Flu Mist, the nasal version of the vaccine, it's available at Martinsville's Health Department. The supply is limited.

Governor Warner introduced a new state budget that includes nearly two-point-four billion dollars in new spending requirements.
Most of that money is earmarked for education, health services, transportation and public safety.

Aviators in Roanoke wanted to take to the skies to celebrate the anniversary of flight but they, too, were grounded by the weather. Regardless, a group of pilots met in the general aviation terminal this morning to be named members of what Mayor Ralph Smith calls the "Roanoke Air Force". Honorary flight commander, Wes Hillman, has been an airman since the early 1930s. Hillman and Mayor Smith sat briefly in a plane around 10:30, near the time the Wright Brothers made their virgin flight. In honor of the anniversary, the airport named today Customer Appreciation Day."

The Yankees did not announce financial terms but the deal, which includes an option for a fourth year, reportedly is worth $39 million. Another NFL coach was shown the door today. The New York Giants fired Head Coach Jim Fassel.

Fassel's seven year tenure will come to an end after the final two games of the season. The Giants have struggled to a 4 and 10 mark with 6 consecutive losses. Fassel took the team to the playoffs three times including a trip to the 2001 Super Bowl.

The Roanoke Valley Sports Journal would give out its Sports Personality of the Year award this afternoon.

This year's winner is John Rocovich, the Rector of the Virginia Tech Board of Visitors. Rocovich was a positive voice or reason in the Hokies' battle to gain entrance into the Atlanta Coast Conference earlier this year.

Robin Williams stole a page from his movie past to greet the troops in Iraq today.
The comedian had troops laughing as he stopped by the U-S base at the Baghdad airport- His performance for thousands is part of a U-S-O sponsored tour.
Last year Williams also visited troops in Afghanistan.
