nats of shouting at martha
day two of testimony in her criminal trial. The prosecution will put on it's star witness today. 28 year old Douglas Fanueil. The former assistant to Stewart's stockbroker and co-defendant, Peter Baconovic.

SOT: Nancy Grace/Former Prosecutor (Court TV)

He's the lynch pin of the State's case.
Faneuil say Stewart cooked up a story about her well time stock sale.
He is expected to testify that Stewart sold nearly 4-thousand shares of Imclone stock after receiving illegal insider information. In fact, Faneuil claims Baconovic ordered him to call Stewart and tell her ImClone founder, Sam Waksal was dumping his shares.
But the baby-faced Faneuil isn't without his own blemishes.

SOT: Grace

This assistant has changed his story three times. The defense will argue that he some type of fixation with Martha Stewart and his reputation as kind of a man about town assistant wanna be...is going to be exploited.
BRIDGE: Stewarts attorneys say Faneuil is an admitted liar. That after he was caught accepting illegal gifts to keep quiet about Stewart...he cut a deal with prosecutors to save his own skin.

SOT: Grace

He has already entered a guilty plea on a misdemeanor--the max he could serve his one year -(but if he sings beautifully on the stand for prosecutors it is very doubtful he will ever go to jail.)

(Martha at stove) .
Legal experts aren't sure the 28 year old can handle the heat.

SOT:Grace.

I think he will be great on direct but once cross examination starts given the fact that he has changed his story three times and given that the public by and large likes Martha Stewart..she's got that on her side and that may pull Baconvic through as well.
Defense attorneys hope it will be enough to stir up doubt in the jury and stop any charges from sticking to the most famous homemaker in America. In New York, Sharyn Alfonsi, for CBS News.
