That is the question that a special legislative subcommittee will begin studying.
The Senate Courts of Justice Committee said "no" to additional caps on medical malpractice damages and no to limits on lawyers fees.
Instead, the panel will look into what's causing insurance rates to rise.
The senators also agreed to establish a state-run risk management pool for physicians like Dr. Dan Tershak a Roanoke surgeon who despite having no claims against him, had to close his private practice.

Physicians whose insurance rates have increased 25 percent or more in one year will also be eligible for the program.
Doctors would pay all the expenses but the state would need to front the two million dollar start-up costs.
Lynchburg Senator Steve Newman says the state-run insurance program is the first-of-its-kind in the nation and is necessary to help stop the bleeding in areas like his.

Quilter Carol Mesimer (MEE-simm-err) finished "Big Boys Toys #44" last summer after starting the piece in 1998.
The design was intended to celebrate the 30th anniversary of Hot Wheels.
Her son asked her to feature Kyle Petty's car.
The quilt will be highlighted in Quilter's Newsletter Magazine sometime in the next year.
Mesimer is also behind a push to make teddy bears for Kyle Petty's Victory Junction Gang Camp for terminally ill children.
With help from volunteers she plans to crank out 30 bears.
