Many legislators are feeling more optimistic about the prospects for a state budget agreement.
Now that the House Finance committee reversed itself and reported out a bill that raises almost a billion dollars in new revenue.
The measure would boost the state sales tax by half a penny and add thirty cents to the price of a pack of cigarettes.
Governor Warner praised the move as a breakthrough but stopped short of endorsing the bill.

A Montgomery County Judge is deciding whether or not to keep the media out of the trial of three Virginia Tech Football Players including star quarterback Marcus Vick.

Vick, wide receiver Brenden Hill and running back Mike Imoh are charged with contributing to the delinquency of a minor.
All three are accused of giving teenage girls alcohol and taking pictures of them as they stripped.
Marcus Vick is also accused of having sex with a 15 year old girl.

Defense Attorneys and the Commonwealth's Attorney do not want the media at the trial because they do not want the identity of the victims revealed.
Lawyers for the media argued the case is of national and local interest and involves grown men.

A Radford Photographer may face federal charges in connection with an overdose death of one of his models.

Bob Shell already faces state charges of giving 19 year old Marion Elizabeth Franklin liquid morphine, which led to her death.
Commonwealth's Attorney Randal Duncan says U-S Attorney John Brownlee has agreed to seek federal indictments against Shell.
Brownlee declined to comment.
Shell is under house arrest.

Bedford County authorities say they've caught one of the suspects in a horse attack earlier this week.

Tater, a four year old miniature horse was attacked by what appeared to be two pitbulls Sunday evening, while roaming in his owner's pasture. Animal control officers say they picked up one of the dogs last night at the Hardy Road Mobile Home park, after getting a call that it was attacking another dog. However, Tater's owner, Carol Simmons was not able to identify the pitbull as one of the dogs that attacked him. Officers say the pitbull will be put down, and that the case will remain open until they find the other one.

The son of former Giles County Sheriff Larry Falls has admitted running a drug trafficking business out of his home in Narrows.

[TAKE FALLS FS ] Thirty-six year old James Edwin Falls sold cocaine, marijuana, OxyContin and other prescription drugs, while his wife, Allison, kept the books. She pled guilty in February and is set for sentencing next month.

Evidence presented in federal court today indicated Jimmy Falls also sold drugs at the Celanese plant where he worked.
While there's no evidence Sheriff Falls was ever involved, he allegedly told people in Giles County not to cooperate with federal investigators. Jimmy Falls will be sentenced in July.

The condition of a Craig County man assaulted Monday, has worsened. 65-year-old Richard Sarver was in serious condition late yesterday afternoon, today hospital personnel say Sarver's condition has been downgraded to critical.

Police say he was seriously injured Monday when 22-year-old William Riley Richardson of Clifton Forge attacked him. Richardson faces a number of felony charges including attempted murder, malicious wounding and attempted arson.

According to reports, Richardson attacked the wheelchair bound Sarver when he threatened to call police after Richardson beat a 17-year-old girl. The girl survived with a couple of broken bones, cuts and bruises.

An accident in Bedford County killed one man and sent a woman to the hospital. 44 year old David Michael Dooley of Bedford died after crashing his car on Route 691 around 9-fifteen this morning. State Police say he ran off the left side of the road, then veered off the right side and hit several fence posts. 35 year old Melissa Jane Kersey was a passenger. She was injured . Police say alcohol may have been a factor, but are also investigating whether a medical condition may have contributed to the crash.

Bath County standout John Phillips gave UVa coach Al Groh the word this afternoon that he plans to play for the Cavaliers. Phillips has been recruited by the Hokies, Florida State, Colorado, Kansas and 10 other division one colleges. The six-six 230 pounder injured his knee last season, but is on schedule to make a full recovery. He is projected to be a tight end in college. His older brother Jacob will be a freshman this coming season at William & Mary.

A rare piece of Civil War history is back in the public eye in Lynchburg.

This 1861 cannon had been rotting away in the Community Market basement for more than a decade.
A group called Friends of the Market spent the past two years raising 45-hundred dollars for its restoration.
Ultimately the cannon may be placed at the Fort Early Museum to help illustrate the Battle of Lynchburg.
