A death row inmate who says lethal injection would be cruel and unusual punishment will get his case heard by the U-S Supreme Court.
David Nelson says his veins are so badly damaged because of his intravenous drug use, it would be impossible to give him an injection without cutting deep into his flesh and muscle.
In a unanimous ruling, the U-S Supreme Court says he should be allowed to make his case.
Nelson was convicted of murder in Alabama.
He was less than three hours away from being executed last fall, when the high court granted him a temporary reprieve.

But the high court's decision could affect the local murder case of James Edward Reid.
Reid was scheduled to die by lethal injection last December for killing an 87-year old Christiansburg woman in 19-97. But a federal appeals court stayed the execution. Reid's attorney says it appears his client's veins would also need to be cut to allow for the lethal injection.
