((As the sun was setting, the work was just beginning for many boat owners at Smith Mountain Lake.

Run-off from the Roanoke River and it's tributaries turned what is typically a calm cove into a whirlpool of rising water. And docks that once provided a pathway above the lake, are now underwater themselves. [BITE BOAT OWNER] While some watched from the shore, these boat owners decided to live on their pontoon until the water receedes, which could be quite some time. Smith Mountain lake is expected to rise over 2 feet above normal full pond. If that's happens, many of these boats will be through the roof.

Thanks to record rainfall from Jeanne, there's 4 times as much water rushing into the Smith Mountain Lake than their was this time yesterday. And once the water does finally receede, debris will be the next obstacle boaters will face as they travel up and down the lake.))

Roanoke County Schools have not sent us any school information for tomorrow, but their web site says there is no decision yet whether the following schools will open tomorrow: Mount Pleasant, Masons Cove, Fort Lewis, and all Glenvar schools. All other Roanoke County schools WILL be open tomorrow.

There were some tense moments for some folks in Salem as the highwaters got the best of them. Home video shows a man at the Ramey Trailer Park being swept away. Some neighbors were able to get him before he went under. Salem's swift water rescue team was called to the Willow River Apartments after a family ignored the mandatory evacuation order. Everyone was rescued and returned to safe ground.

Flooding apparently caused a drowning in Patrick County. A Dry Pond woman is dead- it's believed she was swept away in flood waters from Sandy Creek.

The Patrick County Sheriff's Department says the body of 51-year old Katherine L. Smith was found in an outhouse that had been washed about 150-yards downstream. A mobile home had also been dislodged. The Sheriff says Sandy Creek rose to approximately 10 feet and overflowed its banks.

An accident this evening in Franklin County sent four people to the hospital- including a two week old infant.

It happened around 5:15 today on Hardy Road when a Blazer crossed the double yellow line and struck a van. The driver of the Blazer- Kevin Parker of Goodview- has been charged with failure to maintain control of his vehicle and not wearing a seatbelt. William Rye from Roanoke was driving the van- both men are hurt- but their injuries are NOT life threatening. The injuries were more severe for a passenger in the Blazer- Savannah Beckner is in critical condition. The infant who was also in the blazer is doing well but is being kept for observation. All four are at Roanoke Memorial Hospital.

A former state official says he would not have released more than 4 million dollars for the National D-Day Memorial if he had received an accurate picture of the foundation's finances.

Ron Tillett served as Secretary of Finance under Governor Jim Gilmore.
He testified at the fraud trial of former Foundation President Richard Burrow today.
Tillett said he might have asked for an audit if he had known the money was going to pay back existing loans rather fund additional construction as Burrow had maintained.

It appears West Nile virus has claimed its first victim this year in Virginia- in Fairfax County. Health officials say an elderly man died early this month and the diagnosis is still being confirmed by the Centers for Disease Control and Prevention. If confirmed, it will be Virginia's fifth human case and the first fatality from the virus this year.

The river feeds into Smith Mountain Lake, where levels are well above full pond. That left boat owners and marinas scrambling to move and secure their boats. The Roanoke River waters are still high enough to keep many people from returning home. Close to 50 people are spending the night at the Salem Civic Center.
