The state Department of Environmental Quality issued Cooper 274 violation notices just between November of '98 and August, 2000. The sewage lagoon could be upgraded and brought into compliance. In the short term, Cooper could avoid going to jail just by having the lagoon pumped out regularly. Prosecutor Waering says it's not as if Cooper can't afford to fix the problem. She cited just one investment account in his name with a balance of 1-point-six million dollars.
