When Scott Peterson was convicted of
murder last year, he knew the jury
wanted him to die.
But it's up the judge today to take
that recommendation for the death
penalty and make it official.
Peterson was convicted for killing his
wife Laci and their unborn son.
It was a high profile case that lasted
nearly six months.
It included not only an All-American
looking couple expecting their first
child---but a mistress ....Amber Frey
who ended up helping the prosecution
make its case. She did not request a
seat in court today, so more family
could attend.
SOT - AMBER FREY -
"MY PRAYERS ARE WITH THEM, I KNOW THIS
IS A VERY DIFFICULT TIME FOR THEM AND
HAS BEEN VERY DIFFICULT FOR AT LEAST
COUPLE OF YEARS."
(STANDUP: DREW LEVINSON)
BEFORE THE JUDGE CAN RULE-HE MUST FIRST
DEAL WITH A MOTION FROM THE DEFENSE FOR
A NEW TRIAL. THE DEFENSE CLAIMS THE
PROSECUTION WITHELD KEY EVIDENCE THAT
COULD HAVE BROUGHT A DIFFERENT VERDICT.
Peterson's attorney-Mark Geragos says
prosecutors didn't reveal evidence that
a state prison inmate claimed to have
about Laci's disappearance. Geragos
says the inmate was told the pregnant
schoolteacher had interrupted a
burglary at a neighbor's home.
In court papers Geragos wrote he only
found out about the inmate's claim six
weeks before the end of the trial.
Prosecutors countered the information
was provided a year before the trial
began.
Law experts say motions like these
usually fail-if that's the case-then
the focus will once again be on whether
Scott Peterson lives or dies...that
decision lies in the hands of a
California judge. Drew Levinson,
Redwood City, California.
