was involved in a fatal car accident in
June will not face any charges.

A local prosecutor has found that
Officer Timothy VanMarter did not
commit a traffic infraction or criminal
offense.

of the accident.

In report released this afternoon,
he said the officer did not act in a
reckless manner.

Drive near Cave Spring High School, a
curving stretch of road where driveways
have limited visibility.

VanMarter had turned around at Poff
Road, and was accelerating to catch up
with a speeder, when his police cruiser
struck a Ford Expedition that was
pulling onto the road.

Joyce Crawford Hawthorne, seen here
in footage from 2001, died as a result
of the accident.

In his report, Showalter said the
officer did not pursue the vehicle in a
reckless manner.

He wrote, "Officer VanMarter took
due care in turning his vehicle around
on a nearby side road, taking control
of his vehicle, accelerating and
beginning to activate his emergency
equipment."

Though the police car's emergency
lights weren't flashing, Showalter says
VanMarter was in the process of
activating the emergency equipment when

the accident occurred.>>

Showalter also noted state law that
requires a vehicle to stop before
entering a public highway, and the
statement of a passenger who said
Crawford Hawthorne pulled out of the
driveway and "gunned it."

touching an 11 year old boy's groin
area, during band class on several
occasions.

The boy testified today that
White would put his hand on the boy's
thigh and then move it to the groin
area.

But, the boy, who attends Narrows
Elementary/Middle school admitted in
court it could have been an accident.

And another 11 year old who sits
right next to the alleged victim says

he never saw any inappropriate
touching.

:00 Manager Charlie Manuel will miss
tonight's and tomorrow night's games to
attend the funeral for his oldest
sister. Janet Dolores, the oldest of
Manuel's 10 siblings, died after
battling liver and kidney problems.

She was taken off of life support
last week and Manuel told us over the
weekend that her situation was grave.

Manuel plans to return to the
team on Wednesday, and Gary Varsho will
manage the team in his place.
