(END SOT) A MAJOR ABORTION RIGHTS CASE IS ON ITS

WAY TO THE SUPREME COURT. THE JUSTICES
WILL HEAR AN APPEAL ON WHETHER OR NOT A
SPECIFIC TYPE OF MID TO LATE TERM
ABORTION IS CONSTITUTIONAL. ALEEN
SIRGANY HAS THE STORY FROM WASHINGTON.

(PACKAGE SCRIPT) UNDER GROWING
PRESSURE FROM THE WHITE HOUSE TO
REINSTATE THE CONTROVERSIAL LAW, THE
SUPREME COURT WILL DECIDE WHETHER OR
NOT THE BAN ON CERTAIN MID TO LATE TERM
ABORTIONS IS CONSTITUTIONAL.

Jonathan Turley / LAW PROFESSOR: "this
is likely to be the first, but not the
last exception under roe v. wade."

HERE'S THE ISSUE. JUDGES IN SIX LOWER
COURTS RULED, THE FEDERAL BAN IS
"UNCONSTITUTIONAL" BECAUSE IT DOESN'T
INCLUDE AN EXCEPTION THAT PROTECTS THE
HEALTH OF THE MOTHER. THIS FALL -- THE
HIGH COURT WILL DECIDE IF THEY aRE
RIGHT. in the past -- the Supreme
Court struck down a similar ban.

Aleen Sirgany / CBS NEWS: But -- legal
experts say -- this time, the case is
coming before a High Court -- that's a
lot more conservative.") SANDRA DAY
O'CONNOR had been the tie-breaking
vote.. but NOW -- SHE'S RETIRED...
REPLACED BY A MUCH MORE CONSERVATIVE
JUSTICE -- SAMUEL ALITO.

Jonathan Turley / LAW PROFESSOR: He has
a history of being far less deferential
to roe in fact, he has questioned the
legitimacy of roe v wade to begin with.

EVEN WITH ALITO ON THE BENCH... A
MAJORITY OF THE JUSTICES STILL SUPPORT
THE DECISION TO LEGALIZE ABORTION IN
ROE VERSUS WADE. BUT IT LOOKS LIKE 5-OF
THEM "WILL" VOTE TO UPHOLD THIS BAN.

GRAPHIC=None Welcome everyone to your Tuesday

ticker and it's hard to believe but
Spring Training is starting up for
baseball players in both Florida and

Arizona. The Atlanta Braves are once
again the National League East
Defending Champions.

In Camp this year you will find
two players who maybe total opposites
but the feeling is very much the same
for Veteran Pitcher John Smoltz who has
been taking part in big league camp for
what seems like forever and then on the
other end of the spectrum is Brian
McCann the Braves Catcher who takes
over the starting spot this season
after making his major league debut in
2-thousand and 5.

Also this afternoon - NASCAR
suspended Jimmie Johnson's crew chief
Chad Knaus for 3 more races and fined
him $25 thousand dollars for cheating
at Daytona.

As we've said before all of this
sounds stiff - but the money means
nothing to these guys - if NASCAR wants
to make a point - it needs to take away
points.
