murderer from Danville.

Percy Walton was scheduled to be put
to death tomorrow night by lethal
injection.

But U-S District Judge Rebecca Beach
Smith granted a stay based on

Walton's challenge that Virginia's
lethal injection practices are

unconstitutional.

The U-S Supreme Court is in the
process of deciding another case that
challenges execution methods.

Smith ruled today that Walton's
execution should be stayed until the
high court rules in that case.

Walton pled guilty to the 1998
murders of Jessie and Elizabeth
Kendrick and Archie Moore. The victims
were robbed and shot in the head.


The state is appealing today's
decision.

Wednesday.. The senate rejected a
constiutional ammendement that would
ban same sex marriage. the vote 49 to
48 was 11 short of the two-thirds
majority needed to move the measure
forward. President bush who
aggressively pursued the ban says he is
disappointed.. But he and other backers
vowed to continue to build support.

"I think we will get there simply
because the American people know this
is important. The American people know
traditional marriage is a vital
institution."

Aleen Sirgany/CBS News: Supporters
claim the majority of Americans define
marriage as the union between a man and
woman.. and they point to the 45 states
that have taken legal steps to ensure
that same sex couples can not tie the
knot.

Massachusetts is the only state in the
U-S that has legalized same sex
marriages.

Opponents say the proposed amendment
has nothing to do with the preservation
of marriage.

Sen. Dick Durbin/D-Illinois:

"The Republican majority believes if
they can bring these issues which fire
up their political base to the floor
that they will have better luck in the
November election."

Before Election Day arrives...the House
is expected to debate the same sex
marriage ban...but it appears unlikely
to pass there either.

This Season UVA's Tom Hagan was picked up :00 today in the 39th round by the
Pittsburgh Pirates. The one time multi
sport star at Cave Spring hit .357 for
the Cavaliers this past season, driving
in 41 runs and stealing 19 bases in 22
attempts. An all ACC selection, Hagan
will likely play in the outfield as a
professional. In 2002 after high
school graduation, Hagan had to sweat
out 50 rounds, without being drafted.
So, 89 rounds and 4 years later, he'll
finally get a shot at the next level.

on the college bench as a head coach.

Ed Green - who won enough games
to get into the Roanoke College hall of
fame has accepted the head coaching job
at Virginia Western Communicty College.

Green was an assistant under Page
Moir at Roanoke last year - but is
excited about being at the fore front
of Western's push to upgrade its
programs.
