to die last night for killing three of
his Danville neighbors ten years ago.

But, about an hour before he was
set to be executed- Governor Tim Kaine

delayed his sentence.

statement, given the nature of the
crimes, he has no reason to doubt the
judge's decision that death was an
appropriate sentence.

However, it is unconstitutional
to execute someone who's mentally
incompetent and since some courts have
struggled with the question of Walton's
mental capacity, Kaine says he'd like
to have his current mental state
evaluated.

Investigators say Pritchett shot

This is Pritchett's third trial.

He was sentenced to life in
prison in 1999, but that conviction was
overturned by the State Supreme Court.

Pritchett's second trial, last

investigating an accident that sent one
person to the hospital.

Officials responded to Franklin
Turnpike near Westview Drive at around
2:45 yesterday where an Oldsmobile
collided with a backhoe.

The driver of the car had to be
removed.

The driver is in critical
condition at Danville Regional Medical
Center.

A flagman says he tried to signal
the driver to stop, but had to jump out
of the way.

Neither the flagman -nor the
operator of the backhoe was injured.

suggested spiritual advisor Abu
Abdul-Rahman who reportedly led US

manager faced some scary moments, after
a man robbed the place, then forced her
into the trunk of a car.

when a man grabbed her and forced her
back inside.

The victim believes the man had a
gun and he stole money.

his Danville neighbors ten years ago.

However, about an hour before he
was set to be executed Governor Tim
Kaine delayed his sentence.

crimes, he has no reason to doubt the
judge's decision that death was an
appropriate sentence.

However, it is unconstitutional
to execute someone who's mentally
incompetent and since some courts have

to have his current mental state
evaluated.

overturned by the State Supreme Court.

Christiansburg police continue to
search for a man they say robbed a
local restaurant and then forced its
manager into the trunk of a car.

It happened Sunday morning at the
Shakers Restaurant.

The manager was eventually able
to get out of the trunk then ran to a
nearby business for help.

the balance in Montgomery County...

Authorities there say the dogs

attack a woman and her dachshund.

The smaller dog is recovering.

A judge must now decide what

Attorney General Bob McDonnell
says the constitution is clear... the
governor can only spend money
appropriated by the legislature.

Kaine *does* have the power to
order state employees to keep working--
but McDonnell says he just can't

If lawmakers can't reach a budget
compromise in the coming days,
McDonnell suggests extending the
state's current spending levels into
the next bi-ennium.

As the deadline approaches, Kaine
says he'll continue to carry out the

plan to keep the state running.

ENG#1 Percy Walton was scheduled to be put to


death last night for killing three
people in 1996. But minutes after the
Supreme Court refused to grant a stay,
Kaine stepped in and delayed the
execution until December 8th.

That will allow time for an
independent evaluation of Walton's
mental condition and competence.

Testimony is underway in a Montgomery
County murder trial. Eight woman and
five men will ultimately decide if

Livingston "Bud" Pritchett is guilty of
robbery and first-degree murder.
Investigators say Pritchett shot and
killed Estel Singleton at the Ironto
rest stop in 1997. This is Pritchett's
third trial.

And the Roanoke County School board
has adopted a new computer policy.
The policy makes it clear e-mail done
on school computers is not private and
therefore can be monitored by the
school system.

The policy also addresses illegal
downloading, using the technology to
