partly responsible for the death of a
4-year-old Daleville boy.

case for about an hour and a half.

Roanoke The plaintiffs argue the operator
and manufacturer are to blame for their
child's death.
The manufacturer counters it's
just the operators fault.

VO NAT This all stems from a tragic
accident in 2004 when Orville Reedy
accidentaly ran over 4 year old Justin
Simmons with a riding lawn mower.
Reedy backed over the child after
the transmission slipped on a hill.
Justin was in the care of Reedy's
wife Roberta when the accident
happened.
His parents then sued the company
that made the lawnmower and the man who
was on it.
The plaintiffs argue the mower
should have had more safety warnings
and equipment.
Lawyers for MTD, the
manufacturer, argue the company met and
even exceeded safety standards.

The jury must now decide if MTD
was responsible and if so, how much it
should pay.
Orville Reedy has been
dropped from the case.

There's been no formal
settlement, but it's understood that
the Reedy's have insurance that will
cover 100-thousand dollars in damages.

surprised everyone by pleading guilty
to the crime.

they caught two men red handed --
breaking into cars early this morning.
An officer spotted the
suspects around 5 a-m at Pebble Creek
apartments.
When he stopped them, he
found gloves, flashlights and tools in
their pockets.
Officers later found at
least five cars had been broken into.
19-year-old Sidney Via and
21-year-old Antwon Brawley are both
charged with Grand Larceny.
Via was also wanted in Roanoke
City on a Grand Larceny charge.

storm of the hurricane season, Alberto,

More than 20 thousand people in
five coastal counties, stretching more
than 100 miles have been ordered to
leave as Alberto approaches.

the warning and some are staying put.

Livingston Bud Pritchett of first
degree murder and sentenced him to life
in prison.
Pritchett killed Estel Singleton
at the Ironto rest stop back in 1997.;
Lt. Norman Croy says he finally

During three separate trials,
investigators were accused of lying
about a confession, and making up a
racially motivated story.
Croy says the only mistake was
that the confession was accidentally

State have a form of HPV, human
papilloma virus. In fact, 80 percent of
women will be diagnosed with a form of
HPV at some point in their lives and it
is the cause of nearly 70 percent of
all cervical cancer cases.
Gardasil, Merck's latest success,
was approved by the FDA just last week
and prevents HPV if it's administered
from age nine to twenty-six.
While there are some concerns that
this will promote promiscuity, doctors
like Dennis Scribner who's also a
spokesman for Merck, say the bigger
picture is this will essentially wipe
out cervical cancer. And will serve
extremly helpful in third world
countries where women do not get annual
pap smears.

The old Roanoke Touchdown Club
wasn't the only organization honoring
Dale 50 years ago.
The all-everything end started 39
straight games at Tech, played at
Victory Stadium - as he's shown in this
video from the late 50s and he became
Tech's first bona fide All-American.
The later went on to play ten
years in the NFL, win two Super Bowl
titles with the Packers, play under
Vince Lombardi and room with Ray
Nitchske.
Since 1991 he's been at UVA-Wise
working in a number of capacities
including coach, athletic director and
now assistant vice-chancellor for
athletic development.
CARROLL DALE
Dale still goes back to Green bay
every summer and his son and two of his
grandchildren reside in the Upper
Peninsula of Wisconsin.

wears a helmet on the job, but not
while he's riding his motorcycle.
Today, that decision caught up
with him and tonight's he's in serious
condition in a Pittsburgh Hospital.

Ben Roethlisberger was involved
in a motorcycle accident just before
Noon today in downtown Pittsburgh.
According to witnesses Roethlisberger
collided with Chrysler New Yorker, his
head then hit the windshield of the
car, before he rolled over the top of
it, landed on the street and hit his
head on the curb.
His injuries include the loss of
many of his teeth, A fractured left
sinus cavity, a broken jaw, a 9-inch
laceration to the back of his head, and
MINOR injuries to both of his knees.
Roethlisberger underwent seven
hours of surgery most of this afternoon
into the early evening.
By the way since 2003 -
Pennsylvania law does not require
anyone over the age of 21 with a valid
motorcycle operator's license to wear a
helmet.

host to one of the valley's biggest
charitable golf events today.

Roanoke Country Club The 8th annual Kroger golf
tournament that started as a
fund-raiser for the March of Dimes has
now grown to benefit 4 additional
charities this days. The Salvation
Army Turning Point shleter, the Vinton
Needy Family Program, Southwest
Virginia Foodbank, and the Rescue
Mission of Roanoke all now get a cut of
the tournament's proceeds.
It was an afternoon of golf and
good food, the food being provided by
Kroger's own Jim Heninger who was
around when this tournament first teed
off and has seen the growth.
