Cassell remains on the job tonight, he
says he is NOT resigning or taking a
leave of absence, at least not for the
time being.

federal charges, Cassell released a
statement through his attorneys saying
he "will carefully assess his ability
to carry out his duties as Sheriff".

In the statement, Cassell says he
is intensely aware of the
investigation's effect on his
department, but he reminds us he is
innocent until and unless proven
guilty.

the county prosecutor were considering
the fallout from the federal
indictments.

CASES AT WHICH OFFICERS WHOSE INTEGRITY
HAS BEEN IMPUGNED BY THESE INDICTMENTS

Regarding past cases,
Commonwealth's Attorney Bob Bushnell
said he does not believe any of the
actions outlined in the indictments
targeted criminal defendants.

But he said he won't be surprized
if some who were convicted file motions
for new trials.

But on the morning of his escape from
Montgomery Regional Hospital Morva was
with just one deputy, Russell
Quesenberry.

Quesenberry told the court Morva asked
to go to the bathroom after being
examined by a doctor.

Quesenberry says he opened the bathroom
door a short time later, but all he

remembers now is seeing Morva standing
up in his boxers and t-shirt, his
orange prison jumpsuit on the floor.

But police believe Morva beat the
deputy with a toliet paper dispenser
and took his gun.

The key witnesses for the prosecution
is Jennifer Preston.

She was a patient that morning and

saw Morva in the Emergency Room with a
gun pointed at security guard Derrick
McFarland.

Preston told the courtoom quote, "he
was pointing the gun at him and was
standing still and then he just shot
him."

The final witness was Morva's Doctor.
He says he heard gun shots and saw
Morva run past him and then shoot his
way through the Hospital's sliding
glass doors. The doctor then ran to
help Derrick McFarland and saw Deputy

Quesenberry staggering out of the
bathroom with the toilet paper
dispenser still around his head.



RACHEL DEPOMPA:

Defense attorneys for Morva did
not want to comment on the case.

The judge ruled there was enough
evidence to move 4-charges against
Morva forward to a grand jury. Rachel

man outside a Roanoke restaurant will
get a new trial.

File Tape Timothy Workman was in Roanoke
on assignment back in 2002, when he got
into an argument with Keith Bailey.


Workman's gun went off,
killing Bailey.

Workman was convicted of
voluntary manslaughter and sentenced to
five years in prison.

He appealed to the state
supreme court, arguing prosecutors
withheld evidence that would have
showed he acted in self-defense.

In an opinion released today,
the court agreed and ordered a new
trial.

No word yet if prosecutors will
seek new charges

the Armed Forces Recruiting Center on
Lakeside Drive around nine.

It appeared to be a bottle
containing some type of liquid, wrapped
inside a plastic bag and sealed with
duct tape.

Haz-mat crews and firefighters were

destroyed the package with a

water-filled projectile.

Police say the package was "not"
dangerous, but they still want to know
who might have left it there and why.

Officers would not reveal the

The Tennessee homeowner called in
wildlife crews....

After being shot with a
tranquilizer, the bear falls asleep
between some branches.

So a wildlife worker pokes the
bear with a poll and a few minutes

later the bear falls to the ground.

The bear was unharmed....and will
be released.
