They're accused of gunning down two men
and injuring four others on this bridge
back in the chaotic days following
Hurricane Katrina...

NAT/SOT LOOTING FILE

(NARR:)

-- those days when lawlessness was the
order of the day -- and so many New
Orleans Police Officers simply fled
their beats.

The officers were called to the bridge
on reports of gunfire -- and say they

shot the men only after being fired
upon themselves.

(GRAPHIC:)

But New Orleans district attorney Eddie
Jordan convinced a grand jury last week
to indict the officers, whom he says
shot the civilians "without
justification like rabid dogs."

NAT/SOT PROTEST

(NARR:)

The case has split this city -- with
some protesters today shouting racism
-- arguing that one of the victims --
who was mentally retarded -- had been
shot in the back.

But one of the officer's attorney
cautions that both sides of the story
haven't been heard.

(SOT/FRANK DESALVO, ATTORNEY)

"They know full well that those people
were shootIng on the bridge. They act
like no one was shooting but the
police."

(COWAN ON CAM:)

"The officers accused of first degree

murder will not be granted bail, and if
convicted, could face the death
penalty. Lee Cowan, CBS News Dallas."

NATs 'Fly Me to the Moon' (keep music
up under track)

1/ For four decades...WHEREEVER jazz
trumpeter Valery Ponomarev flew, his
rare 1961 Constellation trumpet flew
with him...as carry-on luggage.

(SOT/Valery Ponomarev/1:04:46)

THIS (pointing to trumpet) IS THE
PRIZED POSSESSION OF VALERY POMONAREV.

2/ SO PRIZED that when screeners at a
Paris airport told him he needed to
CHECK his trumpet as cargo before
boarding a plane home to New York City
recently, he REFUSED.

(SOT/Valery Ponomarev/2:11:29)

FOR ME OR ANY MUSICIAN TO PUT AN
INSTRUMENT UNDER,// IT'S THE SAME LIKE
FOR A MOTHER TO PUT HER BABY INTO A
LUGGAGE COMPARTMENT. (55)

3/ Unfortunately, for Valery -- those
feelings were not shared by the French
Police.

(SOT/Valery Ponomarev /1:17:00)

THEY JUST SMASHED ME AGAINST THE WALL
LIKE THAT AND RIPPING AWAY THE HORN
FROM ME.// (1:18:17) IMAGINE THIS, FOUR
BIG GUYS, ONE OF THEM LINES UP MY ARM

BEHIND ME LIKE THAT AND BREAKS IT, JUST
LIKE THAT. TR: BROKE YOUR ARM? HE DID
IT, JUST LIKE THAT.

(ON-CAM)

MUSICIANS LIKE VALERY ARE GETTING
CAUGHT IN THE CROSS HAIRS OF INCREASED
SECURITY. THEY NEED TO GET TO THEIR
CONCERTS...BUT THEY CAN'T BEAR THE IDEA
OF LEAVING THEIR INSTRUMENTS...MANY OF
WHICH ARE CENTURIES OLD AND OFTEN WORTH
HUNDREDS OF THOUSANDS OF DOLLARS....AT
THE MERCY OF BAGGAGE HANDLERS.

(SOT/KRISTA BENNION FEENY/20:10)

YOU WOULDN'T PUT A MONA LISA IN A
SUITCASE AND CHECK IT UNDER A PLANE.
//THAT'S NOT HOW YOU TAKE CARE OF WORKS
OF ART AND THESE ARE ALL WORKS OF ART.
USABLE WORKS OF ART.

NAT BACH CANTATA (keep music up under
track)

6/ Krista Feeny practices HER art on a
230 year old, handmade Italian
violin....rather than risk checking

instruments, she and her fellow
musicians with St. Luke's Orchestra in
New York CANCELLED a European tour this
fall, amid a heightened security alert.

(SOT/Feeny/4:50)

IT'S INTIMIDATING TO//NOT BE ABLE TO
FULFILL YOUR PROFESSIONAL OBLIGATIONS
BECAUSE AN AIRLINE ATTENDENT SAYS YOU
CANNOT TAKE YOUR VIOLIN ON BOARD.

4/ The Transportation Security
Administration DOES say instruments ARE
permitted as carry-ons...

(NAT instrumentalist at airport)

THEY ALWAYS TRY TO TAKE IT AWAY

5/ BUT -- The FINAL decision on whether
an instrument will wind up in the cargo
hold or under a seat is up to
INDIVIDUAL flight crews.

NATs (valery on trumpet)

8/ As for Valery a metal plate now
holds the bones in his arm together and

he's beginning to play again. But his
travel nightmare was not over. When he
finally boarded his flight to New York,
French authorities insisted that his
prized possession come home.. as cargo.

(VALERY) I walked through

(tr) with no trumpet?

(VALERY) Yeah.. What can I say.

9/ One last sour note to end the worst
gig of his life. TR, CBS News, NY
