to the hospital after being struck by a
vehicle yesterday.

It happened at around 6 O' clock
in the 1300 block of Washington Street.

Police say a 4-year-old boy was
hit by a Plymouth, when he went into
the street to retrieve a football.

The child was taken to the
hospital, and is listed in stable
condition.

The investigation did not reveal
any traffic violations on the part of
the driver.

Attorney General Bob McDonnell
says the information was put together
as an investigative tool -- and is
therefore exempt from the Freedom of
Information Act.

A state police spokeswoman says
the attorney general's opinion does not
carry the weight of law, but state
police are treating it like advice from
an attorney.

McDonnell issued the opinion at
the request of Delegate David Nutter of
Montgomery County.

He said he received numerous
calls from angry constituents after The
Times obtained the database from state
police and published it online last
month.
